1. Introduction

By using the Outband Boilerplate and the Outband website/application (collectively, the "Product"), you agree to be bound by these terms. Outband is owned and operated by everyday dev LLC, a Michigan Limited Liability Company.

2. Agreement to Terms and Conditions

This Agreement takes effect on the date you first purchase, download, or access any part of the Outband Boilerplate or use the Outband application.

3. Software License with Termination Rights

Purchase of the Outband Boilerplate grants you a perpetual license to use the code for your personal and commercial projects. everyday dev LLC reserves the right to terminate your access to the Service (including future updates and documentation access) without a refund if you are found to be in violation of the license terms.

4. Refunds

Due to the nature of digital products and the fact that the source code is visible and accessible immediately upon purchase, the Outband Boilerpalte cannot be refunded, returned, or exchanged once access has been granted.

5. Disclaimer & Hardware Risks

It is not warranted that the Outband website/application or Outband Boilerplate will meet your specific requirements or that its operation will be uninterrupted or error-free.

5.1 Hardware Acknowledgement

Outband and the Outband Boilerplate is a software bridge. You acknowledge that Bluetooth Low Energy (BLE) and hardware integration carry inherent risks. everyday dev LLC is not responsible for any hardware malfunctions, "bricked" devices, or connectivity failures resulting from the use of this Product. All implied warranties, including fitness for a particular purpose, are expressly disclaimed.

6. Warranties and Limitation of Liability

Outband does not give any warranty or guarantee as to the quality or fitness for purpose of the software. everyday dev LLC shall not be liable for any loss of profit, loss of data, or any indirect, special, or consequential damages arising out of the use of this Product. Notwithstanding any contrary clauses, in the event that everyday dev LLC is deemed liable to you, you agree that total liability is limited to the actual amount paid by you for the software. You hereby release everyday dev LLC from all obligations and claims in excess of this limitation.

7. User Responsibility

everyday dev LLC is not responsible for the final application created by the user or the behavior of the hardware controlled by said application. The user is responsible for ensuring their finished product complies with local electronic and radio frequency regulations.

8. Price Adjustments

As we continue to improve Outband and add new features (such as enhanced firmware templates or UI components), the price may increase. Your purchase secures lifetime access to the version purchased and subsequent updates for that version, regardless of future price hikes.

9. General Terms and Law

This Agreement is governed by the laws of the State of Michigan, United States. You acknowledge that no joint venture, partnership, employment, or agency relationship exists between you and everyday dev LLC. You agree that any legal disputes arising from this agreement shall be handled exclusively in the courts of Michigan.
